F&P Extended Care Warranty Program – Terms and Conditions

Terms and Conditions of Extended Care Warranty for F&P ICON+ Auto, Premo and Novo CPAP devices

 

  1. In addition to the rights and remedies to which you may be entitled under the Australian Consumer Law, by purchasing this Extended Care Warranty for the F&P ICON+ Auto, Premo or Novo CPAP machine (“Extended Care Warranty”) you will be entitled to the benefits set out in these terms and conditions (“Terms and Conditions”) for a period of 5 years from the date of purchase by the end-user.

  2. Subject to the exclusions set out in these Terms and Conditions, the Extended Care Warranty will provide a guaranteed minimum remedy where your F&P ICON+ Auto, Premo or Novo CPAP machine (“Product”) breaks down or otherwise becomes inoperable, irrespective of whether the inoperability is caused by fair wear and tear or some other reason covered by the Extended Care Warranty.

  3. This Extended Care Warranty does not cover damage caused by:
    • accident;
    • misuse or abuse;
    • modification;
    • failure to follow instructions for use;
    • unsuitable physical or operating environment;
    • failure caused by a product not supplied or manufactured by Fisher & Paykel Healthcare;
    • other defects not related to materials or workmanship; or
    • failure to use original spare parts.

  1. This Extended Care Warranty is provided by the manufacturer, Fisher & Paykel Healthcare Limited of 15 Maurice Paykel Place, East Tamaki, Auckland, New Zealand, phone: +64 9 574 0100, email: info@fphcare.co.nz, but is only available when you purchase the Product from an authorised Fisher & Paykel Healthcare dealer in Australia. The Extended Care Warranty program is not currently available in countries outside of Australia.

  2. To make a claim under this Extended Care Warranty program, the CPAP customer must: Contact the Fisher & Paykel Healthcare dealer from whom they purchased the Product to arrange the return of the Product to the dealer; and Provide proof of purchase (i.e. sales receipt) to the Fisher & Paykel Healthcare dealer. On receipt of a warranty claim during the Extended Care Warranty period, the relevant Fisher & Paykel Healthcare dealer will arrange for the Product to be returned to Fisher & Paykel Healthcare at the expense of Fisher & Paykel Healthcare.

  3. If this Extended Care Warranty applies, Fisher & Paykel Healthcare will, after receipt of the Product, at its option and expense, repair or replace the Product or the defective material or part. If Fisher & Paykel Healthcare repairs or replaces the Product, the warranty period for the repaired or replaced Product does not extend beyond the original period of the Extended Care Warranty. Fisher & Paykel Healthcare will pay the expenses for shipment of the repaired or replacement Product to you.

  4. This Extended Care Warranty does not apply if the ownership of the Product is transferred or assigned to any third party or if the Product is used for rental or trial purposes.

  5. Your rights under this Extended Care Warranty are in addition to and do not in any way affect any other rights or remedies that you have under any law which relates to the Product.

  6. Our products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the products repaired or replaced if the products fail to be of acceptable quality and the failure does not amount to a major failure.

  7. At the time of purchasing the Extended Care Warranty, we will collect personal information about the CPAP customer for the purpose of administering the Extended Care Warranty, including processing claims and responding to queries. The information will be held by Fisher & Paykel Healthcare Limited and will be maintained at 15 Maurice Paykel Place, East Tamaki, Auckland, New Zealand. The personal information will be used by Fisher & Paykel Healthcare Pty Limited and Fisher & Paykel Healthcare Limited for administering the Extended Care Warranty. The CPAP customer has the right of access to and correction of any personal information supplied to and held by Fisher & Paykel Healthcare.
  8. Should a Fisher & Paykel Healthcare authorised dealer cease trading and/or representing our CPAP range, all Extended Care Warranty claim queries should be referred or redirected to the Fisher & Paykel Healthcare Australian Head Office on (03) 9879 5022.
